Terms of Service

Clear rules for a fair platform.

Welcome to Reclu ("Platform"), a service provided by Everseed Ventures ("Company," "we," "us," or "our"), a company builder and tech enabler based in Calgary, Alberta.

By accessing or using Reclu, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

1. Definitions

  • "Client" refers to the recruiter, hiring agency, or employer who subscribes to Reclu to assess candidates.
  • "Candidate" refers to the job applicant or individual invited to perform an AI-simulated interview or assessment.
  • "User" refers to both Clients and Candidates collectively.
  • "Simulated Assessment" refers to the AI-driven web calls, simulated websites, or chat interfaces used to gather Candidate data.

2. The Service

Reclu provides an AI-powered pre-filtering tool that allows Clients to configure assessments. The AI analyzes Candidate responses based on parameters set by the Client.

  • No Hiring Decisions: You acknowledge that Reclu is a data processing tool. The AI provides analysis and scores, but Reclu does not make hiring decisions. The Client is solely responsible for all employment decisions.

3. Terms for Clients (Recruiters)

3.1 Authorization and Data Warranty

By uploading Candidate contact information or resumes to the Platform, you represent and warrant that:

  1. You have obtained all necessary consents and authorization from the Candidate to share their data with Reclu for processing.
  2. You have the legal right to contact the Candidate.
  3. Your use of the Platform complies with all applicable labor and privacy laws.

3.2 Configuration of AI

You are responsible for the parameters and criteria you set for the AI analysis. You agree not to configure the AI to discriminate against Candidates based on race, religion, gender, age, disability, or any other protected class under applicable law.

3.3 Indemnification

You agree to indemnify and hold Everseed Ventures harmless from any claims, damages, or liabilities arising out of your failure to obtain necessary Candidate consents or your misuse of the Candidate data.

4. Terms for Candidates

4.1 Participation and Consent

By participating in a Simulated Assessment, you agree to:

  1. Recordings: Allow Reclu to record audio, video, and screen interactions as required by the assessment.
  2. AI Analysis: Allow our AI algorithms to analyze your behavioral, verbal, and non-verbal data to generate a report for the Client.
  3. Data Sharing: You grant Reclu the right to share your assessment results, recordings, and uploaded documents strictly with the specific Client (Recruiter) who invited you.

4.2 Data Accuracy

You represent that any information you provide (resumes, answers during the simulation) is accurate and truthful. You may request updates to your data as outlined in our Privacy Policy.

5. Intellectual Property and Data Rights

5.1 Platform Ownership

Everseed Ventures retains all rights, title, and interest in the Reclu Platform, including the AI models, software, and underlying technology.

5.2 Client Data

The Client retains ownership of the specific job descriptions and criteria uploaded to the Platform.

5.3 Data Usage Restriction

Strict Use Policy: Reclu agrees that data collected from Candidates (video, audio, transcripts) will be used solely for the purpose of facilitating the recruitment process for the Client. We will not sell this data to third parties or use it to train public-facing AI models without explicit, separate consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law (including the laws of Alberta), Everseed Ventures shall not be liable for:

  1. Any indirect, incidental, or consequential damages.
  2. Any hiring decisions made by the Client based on Reclu’s analysis.
  3. Any technical errors or "hallucinations" produced by the AI during the simulation.

7. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada. Any disputes shall be resolved in the courts located in Calgary, Alberta.
